App terms of use

The rules for using the ELY app for Android and the ELY 2 software it gives access to.

Purpose and acceptance

These terms govern the use of the ELY app for Android, published by Franck OLLIVIER (see the legal notice). By installing or using the app, you accept these terms. If you do not accept them, do not use the app.

Description of the service

The app gives access to ELY 2, a personal AI agent that converses, remembers your preferences, organizes your tasks and can act on your behalf according to the access you grant it: browsing websites, email, calendar, posts or messages.

The app requires an ELY 2 instance, installed by you or by an administrator on a server they control. The publisher provides no hosting, no account and no access to an AI model.

Free of charge and license

The app is free, with no in-app purchases, no subscription and no ads. The source code of ELY 2 is available on GitHub under the MIT license, which governs its use, modification and redistribution.

Any costs of AI model providers and connected services are borne by the person who configures them, at their own rates.

Access and account

Your account is created on your instance by its administrator or through an invitation. Keep your credentials confidential and notify the administrator of any unauthorized use.

The administrator of an instance can create, suspend or delete the accounts on their instance. They are responsible for its configuration, its security and the services they connect to it.

Artificial intelligence and autonomous actions

ELY’s answers are produced by AI models. They may be inaccurate, incomplete or unsuitable. Check important information before relying on it.

ELY can act autonomously, within the limits of the access you give it: sending a message, publishing content, booking an appointment or using a saved credential. You decide on this access, you can withdraw it at any time and you remain responsible for the actions carried out on your behalf. Check important actions, especially those involving payments, contracts, third parties or your accounts.

Prohibited uses

You agree not to use the app or ELY to:

break the law or infringe the rights of others, including privacy, image rights or intellectual property; send unsolicited bulk messages, harass, deceive or commit fraud; access systems, accounts or data without authorization; circumvent security measures or the terms of use of third-party services; collect or process third parties’ personal data without a legal basis.

Third-party services

ELY works with third-party services: AI model providers, Google, LinkedIn, Facebook, Telegram, email services and websites. Their use is subject to their own terms, which you must comply with, including their rules on automation. The publisher does not control these services and guarantees neither their availability nor how they process data.

Personal data

The data processed by the app, how it is shared and how to delete it are described in the app privacy policy. If you use ELY to process other people’s data, particularly in a professional context, it is your responsibility to comply with the rules applicable to that processing.

Warranties and liability

The app and the software are provided free of charge, “as is”, without any warranty of operation, availability, compatibility or results.

To the extent permitted by law, the publisher, acting in a personal and non-professional capacity, is not liable for data loss, for actions carried out by ELY with the access you granted it, for the operation of your instance or for third-party services.

Nothing in these terms limits the rights you hold under mandatory legal provisions, or the publisher’s liability for gross negligence or intentional misconduct.

Intellectual property

The ELY 2 software is distributed under the MIT license. Third-party names, trademarks and content remain the property of their owners. The content you create with ELY belongs to you, subject to the rights of third parties and the terms of the model providers.

Changes to these terms

The publisher may change the app or these terms, or stop distributing the app. The date shown at the top of the page indicates the last update. Continuing to use the app after a change means you accept the new terms.

Governing law and contact

These terms are governed by French law, subject to the mandatory provisions of your country of residence. If a problem arises, first write to contact@agent-ely.fr so that an amicable solution can be sought. Failing that, the dispute will be brought before the competent courts under the ordinary rules of jurisdiction.
